1. Acknowledgement and Acceptance

By accessing or using XPRESS FIBER’s Wi-Fi Service (“Service”), you confirm you have read, understood, and agree to these Terms and Conditions (“Terms”), any Wi-Fi plan/pack terms, and our Privacy Policy. These Terms may be updated on our website with 15 days’ notice via email or portal; continued use implies acceptance. We may verify your details (e.g., mobile number) and reserve the right to approve/refuse Service. This is an electronic record under the Information Technology Act, 2000 (as amended), requiring no physical signature.

2. Definitions

  • XPRESS FIBER/We/Us/Our: XPRESS FIBER PRIVATE LIMITED (under Companies Act, 2013), its successors, and assignees.

  • Service: Wireless broadband internet access via designated Wi-Fi hotspots using compatible devices.

  • Subscriber/You/Your: Any person or authorized representative accessing the Service.

  • Bandwidth: Data transfer capacity, shared and non-dedicated.

  • Equipment: Hardware/software (e.g., routers, modems) needed for Service delivery.

  • Third-Party Content: Content from external sources accessed via the Service.

3. Service Description

The Service provides internet access at selected hotspots (locations listed on our website/app), subject to network availability. It operates under our DoT ISP License and TRAI regulations. Service may be suspended due to government orders, maintenance, or data/validity exhaustion (your responsibility to monitor via app/SMS alerts). We aim for 99% monthly uptime and speeds within 80% of plan limits per TRAI QoS benchmarks.

4. Usage Rules (Acceptable Use Policy – AUP)

You agree to use the Service lawfully and responsibly. Prohibited activities include:

  • Illegal: Spam, fraud, hacking, child exploitation, piracy, export violations, threats, or pornography distribution (per IT Act, 2000; Copyright Act, 1957).

  • Unacceptable: High-bandwidth P2P/torrents beyond fair usage, viruses/DoS attacks, reselling Service, IP infringement, or harassment.

We do not routinely monitor usage but may inspect transmissions for compliance, cooperate with law enforcement, and suspend/terminate violators without notice. You indemnify us against claims from your misuse.

5. Charges and Payments

Plans are prepaid/postpaid (monthly/quarterly/half-yearly/annual) with taxes. Bills emailed to your registered ID; check via portal.

  • Payment: Due by invoice date; 2% monthly interest on delays.

  • Plan Changes: Effective next cycle; no prepaid adjustments.

  • Refunds: Pro-rata for proven QoS failures (>24hr downtime) or voluntary termination (7 days’ notice, post-activation). No refunds for misuse, data exhaustion, or unused prepaid data. Activation fees non-refundable.

Non-payment suspends Service; reinstatement at our discretion after full dues.

6. Modifications

We may update Terms/plans with 15 days’ notice (email/website). Review regularly; we are not liable for changes.

7. Security and Privacy

Internet use carries risks (e.g., hacking, data loss). Protect your passwords; notify us immediately of breaches—we’ll reset access. We implement reasonable security (e.g., encryption) per DPDP Act, 2023, but provide “AS IS” without absolute guarantees. Re-authentication may occur after inactivity/data limits. Not liable for third-party breaches unless due to our gross negligence.

8. Warranties and Disclaimers

Service provided “AS IS” with no warranties beyond TRAI QoS (e.g., 98% availability, 4-hour fault repair). Speeds vary by device/load. Not liable for viruses, Third-Party Content accuracy, or business losses.

9. Third-Party Content

We control no external sites/links. You bear full responsibility for accessed content/transactions; copyright violations are your liability.

10. Limitation of Liability

Liability capped at fees paid in the prior 3 months. Excluded: Force majeure (e.g., acts of God, govt orders, strikes), indirect damages, or events beyond control. TRAI QoS penalties apply for failures.

11. Termination

  • By You: 7 days’ notice; pro-rata refund if eligible.

  • By Us: Immediate for AUP breach/misuse; 30 days’ notice otherwise. Dues remain payable. No refunds for user-fault terminations.

12. Indemnification

You indemnify us against losses from your Service use, violations, or misrepresentations.

13. Dispute Resolution

  • First: Grievance Officer (contact: support@xpressfiber.com; resolve within 10 days per TRAI).

  • Escalation: TRAI portal/TDSAT (service issues); mutual arbitration (Arbitration Act, 1996; venue: Bhagalpur). Mumbai courts have jurisdiction.

14. Intellectual Property

All Service IP belongs to us/licensors; no transfer to you.

15. Miscellaneous

  • Governing Law: Indian laws; Bhagalpur jurisdiction.

  • Severability: Invalid clauses do not affect others.

  • Notices: Email/post to registered details; ours to support@xpressfiber.com.

  • Compliance: Adheres to TRAI/DoT; no sub-licensing.

  • Support: 24/7 helpline: 97716 14723; app for usage tracking.

These Terms supersede priors. Last Updated: Feb 13, 2026.
